1. I performed asr behind imam after he finished 1st rakah, then I gave salam when he gave, then I realized I missed… 2. I’m in bangladesh studying , but I go home to srilanka once a year for about 1month vacation, can I do jamu qasr there?

1.      I want to know whether my salat is valid: I performed asr behind imam after he finished 1st rakah, then I gave salam when he gave, then I realized I missed 1 rakah so soon without talking to any one I got up and completed 1 rakah with same niyyah.

2.      I’m in bangladesh studying , but I go home to srilanka once a year for about 1month vacation, can I do jamu qasr there? Or when I come here from srilanka, can I do jamu qasr. Please explain clearly.

3.      My friend is engaged and had an affair with a girl before, now he wants to tell that to his wife, for that reason can he talk to her directly or through phone. Or atleast can he talk to her to about her and exchange ideas.

Answer

Assalāmu `alaikum Warahmatullāhi Wabrakatuh,

 

1.      If a latecomer (masbūq) mistakenly made salām with the imām and his salam coincided exactly with the imam’s salam and thereafter he realised that he has missed some rak`āts, then he should stand up and complete his salāh. Sajdah sahw will not be necessary in this scenario.

If a latecomer mistakenly made salam but his salam was after the salām of the imam and thereafter he realised that he has missed some rak`āts, then he should stand up and complete his salāh and also make sajdah sahw at the end of his salah. In this case if one did not make sajdah sahw, the salah will still be valid.[1]

 

2.      It is not permissible to do jam`ul qasr (join between two salah due to travelling) neither in Bangladesh nor in Sri Lanka.

A person may perform al-jam`us sūrī (apparent joining). That is he will perform his Zuhr salāh in its last (ending) time and `Asr salāh in its first (beginning) time. In this manner both salāh will be performed in their prescribed times.[2]

 

3.      We understand from your question that your friend is engaged to a girl and wants to talk to her prior to marriage about his affair he had with another girl.

 

It is not permissible to talk to a girl before marriage. There is no need for your friend to tell his future wife about his sins. He should regret his past and make sincere tawbah for his past together with making a firm resolution to lead an upright life.

والأصل أن السلام العمد يوجب الخروج عن الصلاة إلا سلام من عليه السهو وسلام السهو لا يوجب الخروج عن الصلاة لأن السلام محلل في الشرع قال النبي وتحليلها التسليم ولأنه كلام والكلام مضاد للصلاة إلا أن الشرع منعه عن العمل حالة السهو ضرورة دفع الحرج لأن الإنسان قلما يسلم عن النسيان وفي حق من عليه سهو ضرورة التمكن من سجود السهو ولا ضرورة في غير حالة السهو في حق من لا سهو عليه فوجب اعتباره محللا منافيا للصلاة

 إذا عرفنا هذا فنقول إذا سلم وهو ذاكر أن عليه سجدة صلبية فسدت صلاته وعليه الإعادة لأن سلام العمد قاطع للصلاة وقد بقي عليه ركن من أركانها ولا وجود للشيء بدون ركنه وإن كان ساهيا لا تفسد لأنه ملحق بالعدم ضرورة دفع الحرج على ما مر ثم إن سلم وهو في مكانه لم يصرف وجهه عن القبلة ولم يتكلم يعود إلى قضاء ما عليه

المسبوق بركعة اذا سلم مع الامام ساهيا لايلزمه سجود السهو لانه مقتد بعد وان سلم بعد الامام كان عليه السهو لانه صار منفردا

وإن سلم بنية القطع من وجب عليه السهو فهو في الصلاة إن سجد للسهو وإلا لا عندهما وهو الأصح وعند محمد وزفر رحمهما الله تعالى هو فيها وإن لم يسجد فبعد السلام إن اقتدى به رجل صح عند محمد رحمه الله تعالى مطلقا وعندهما صح إن سجد للسهو وإن قهقه انتقض الوضوء عنده خلافا لهما وصلاته تامة إجماعا وسقط عنه سجود السهو

وروى الحسن عن أبي حنيفة أن التأخير في الصلوات كلها أفضل في جميع الأوقات والأحوال وهو اختيار الفقيه الجليل أبي أحمد العياضي وعلل وقال إن في التأخير ترددا بين وجهي الجواز إما القضاء وإما الأداء وفي التعجيل ترددا بين وجهي الجواز والفساد فكان التأخير أولى والله الموفق

 وعلى هذا الأصل قال أصحابنا إنه لا يجوز الجمع بين فرضين في وقت أحدهما إلا بعرفة والمزدلفة فيجمع بين الظهر والعصر في وقت الظهر بعرفة وبين المغرب والعشاء في وقت العشاء بمزدلفة اتفق عليه رواة نسك رسول الله أنه فعله ولا يجوز الجمع بعذر السفر والمطر
