In the name of Allah, Most Gracious, Most Merciful


Assalaamu `alaykum waRahmatullahi Wabarakatuh

We understand from your question that the property was sold before distribution of the estate. Based on this understanding, zakah will not be wajib until the inheritors collect their shares. After collecting their share it will be joint with other zakatable wealth and paid at zakah year end.

بدائع الصنائع – (2 / 90) دار الكتاب

 وأما الدين الضعيف فهو الذي وجب له بدلا عن شيء سواء وجب له بغير صنعه كالميراث أو بصنعه كالوصية ( ( ( كما ) ) ) أو وجب بدلا عما ليس بمال كالمهر وبدل الخلع والصلح عن القصاص وبدل الكتابة ولا زكاة فيه ما لم يقبض كله ويحول عليه الحول بعد القبض

بدائع الصنائع – (2 / 91) دار الكتاب

وذكر الكرخي أن هذا إذا لم يكن له مال سوى الدين فأما إذا كان له مال سوى الدين فما قبض منه فهو بمنزلة المستفاد فيضم إلى ما عنده والله أعلم
