Talaaq with waswasa

I am suffering a worst situation regarding Divorce.

I have done Nikah few months ago; my marriage has not been consummated. I love my wife so much and neither at any point of time, have I thought of to actually leaving her.

 I have problem of talking to myself and the things which I am afraid of or I realize that this would harm me (related to faith as well), I keep on saying myself then denying it, in heart and sometimes even audible way.

Earlier, due to my limited knowledge, I had believed that divorce only occurs when my wife will hear it. And I had said lots of time that I divorce you, I don’t know how many times, in heart and in audible way. But one incident I am sure about in which I said “I divorce you” or “I divorce you not” (not sure), and in that only “divorce” was audible. At this time, I was talking to her with phone, but my wife heard nothing.

Recently, I came to know that it doesn’t need to be heard by the wife. So, I got really panicked, I search lots of answers related to Talaq and watched lots of videos. And since, I got extremely afraid of this, I am again getting lots of thoughts about giving Talaq, at one point I even got afraid of opening mouth to even eat. This words of Talaq and thoughts coming in mind again and again and I keep on thinking that weather I have said in audible way or not. Then after again lots of research, I came to know that few scholars suggest that the Talaq before consummating the marriage, only one talaq counts if you say Talaq, Talaq, Talaq. Then, situation got worse; the thoughts are coming in a way that says that, I give you three divorce, so that complete divorce occur. Then, I searched again, and formed opinion that it is waswasa and in wasasa the Talaq would not count as such. So now, before the thought come, It also come in my mind first that I am doing it as joke, then the word talaq occurs. In all cases, I feel that sometimes I said it in audible way.

In short, whatever I am trying to keep as a guard that my Talaq would not count, I am having thoughts countering to that. At the moment, I am uncertain that at one or two occasions weather I have said “I give you 3 Talaq” under strong compulsion of waswasa or I just said it with my control. For a person affected by waswasa, all incidents of Talaq would be considered as null and void? or will they be seen individually that at this very point was waswasa uncontrollable and he said it jokingly or just normally?

You have our deepest sympathies in these troubling times. We make dua Almighty Allah grant you ease from your difficulties. Aameen.

We understand the dilemma you find yourself in. It appears that you are suffering from a medical condition that affects the balance of your thought and mind. There are many people who experience similar problems and get medical treatment. We advise you to consult a physician and once he diagnoses your sickness, you should make two people your witness that you utter the words of divorce as a consequence of your sickness and you have no intention of divorcing your wife.[i] Accordingly, your pronounces of divorces due to your medical condition will not constitute talaq.[ii]

ج / 24 ص -109- يتبين أن بيع الهازل منعقد تلحقه الإجازة منهما لأن بالهزل لو كان ينعدم اختيار أصل السبب لما صح النكاح والطلاق والعتاق من الهازل وأصل السبب لا بد من اعتباره في هذه الأشياء. وكذلك لو طلق امرأته على مال على وجه الهزل أو أعتق جاريته على مال على وجه الهزل وقد تواضعا قبل ذلك أنه هزل وقع الطلاق والعتاق ووجب المال وهذا عندنا قول أبي يوسف ومحمد أما عند أبي حنيفة رحمه الله فيتوقف وقوع الطلاق والعتاق على وجود الإجازة من المرأة والعبد لما بينا أن الهزل بمنزلة شرط الخيار. وعند أبي حنيفة شرط الخيار في جانب المرأة والعبد يمنع وقوع الطلاق والعتاق ووجوب المال قبل إسقاط الخيار لأن الذي في جانبهما مال فيعتبر بالعقد الذي هو مبادلة مال بمال وعندهما شرط الخيار لا يمنع وقوع الطلاق والعتاق أو هو المقصود بالعقد فأما المال فتبع فيه وثبوت التبع بثبوت الأصل فكذلك الهزل والإجارة والقسمة والكتابة بمنزلة البيع في حكم التلجئة لأن هذه العقود محتملة للنقض بعد وقوعها كالبيع

الا ترى أنهما لو صنعا مثل ذلك في طلاق أو عتاق أو نكاح لم يكن ذلك طلاقا ولا عتاقا ولا نكاحا, وكذلك لو أقر بشيء من ذلك من غير تقدم المواضعة لم يكن طلاقا ولا عتاقا ولا نكاحا فيما بينه وبين ربه وإن كان القاضي لا يصدقه في الطلاق والعتاق على أنه كذب إذا أقر طائعا وقد بينا الفرق بين الإقرار والإنشاء في هذه التصرفات مع الإكراه فكذلك مع التلجئة. ولو كان قبض العبد الذي قال فيه ما قال فأعتقه ثم قامت البينة على ما كانا قالا في السر من المواضعة على الإقرار بطل العتق ورد العبد على مولاه لأنه ثبت أن إقرارهما كان كذبا وأن إعتاقه حصل في غير ملكه فكان لغوا

باب طلاق المدهوش

وَلَا يُنَافِيهِ تَعْرِيفُ الدَّهَشِ بِذَهَابِ الْعَقْلِ فَإِنَّ الْجُنُونَ فُنُونٌ، وَلِذَا فَسَّرَهُ فِي الْبَحْرِ بِاخْتِلَالِ الْعَقْلِ وَأَدْخَلَ فِيهِ الْعَتَهَ وَالْبِرْسَامَ وَالْإِغْمَاءَ وَالدَّهَشَ. وَيُؤَيِّدُهُ مَا قُلْنَا قَوْلُ بَعْضِهِمْ: الْعَاقِلُ مَنْ يَسْتَقِيمُ كَلَامُهُ وَأَفْعَالُهُ إلَّا نَادِرًا، وَالْمَجْنُونُ ضِدُّهُ. وَأَيْضًا فَإِنَّ بَعْضَ الْمَجَانِينِ يَعْرِفُ مَا يَقُولُ وَيُرِيدُهُ وَيَذْكُرُ مَا يَشْهَدُ الْجَاهِلُ بِهِ بِأَنَّهُ عَاقِلٌ ثُمَّ يَظْهَرُ مِنْهُ فِي مَجْلِسِهِ مَا يُنَافِيهِ، فَإِذَا كَانَ الْمَجْنُونُ حَقِيقَةً قَدْ يَعْرِفُ مَا يَقُولُ وَيَقْصِدُهُ فَغَيْرُهُ بِالْأَوْلَى، فَاَلَّذِي يَنْبَغِي التَّعْوِيلُ عَلَيْهِ فِي الْمَدْهُوشِ وَنَحْوِهِ إنَاطَةُ الْحُكْمِ بِغَلَبَةِ الْخَلَلِ فِي أَقْوَالِهِ وَأَفْعَالِهِ الْخَارِجَةِ عَنْ عَادَتِهِ، وَكَذَا يُقَالُ فِيمَنْ اخْتَلَّ عَقْلُهُ لِكِبَرٍ أَوْ لِمَرَضٍ أَوْ لِمُصِيبَةٍ فَاجَأَتْهُ: فَمَا دَامَ فِي حَالِ غَلَبَةِ الْخَلَلِ فِي الْأَقْوَالِ وَالْأَفْعَالِ لَا تُعْتَبَرُ أَقْوَالُهُ وَإِنْ كَانَ يَعْلَمُهَا وَيُرِيدُهَا لِأَنَّ هَذِهِ الْمَعْرِفَةَ وَالْإِرَادَةَ غَيْرُ مُعْتَبَرَةٍ لِعَدَمِ حُصُولِهَا عَنْ الْإِدْرَاكِ صَحِيحٌ كَمَا لَا تُعْتَبَرُ مِنْ الصَّبِيِّ الْعَاقِلِ نَعَمْ يُشْكِلُ عَلَيْهِ مَا سَيَأْتِي فِي التَّعْلِيقِ عَنْ الْبَحْرِ. وَصَرَّحَ بِهِ فِي الْفَتْحِ وَالْخَانِيَّةِ وَغَيْرِهِمَا، وَهُوَ: لَوْ طَلَّقَ فَشَهِدَ عِنْدَهُ اثْنَانِ أَنَّك اسْتَثْنَيْت وَهُوَ غَيْرُ ذَاكِرٍ، وَإِنْ كَانَ بِحَيْثُ إذَا غَضِبَ لَا يَدْرِي مَا يَقُولُ وَسِعَهُ الْأَخْذُ بِشَهَادَتِهِمَا وَإِلَّا لَا اهـ مُقْتَضَاهُ أَنَّهُ إذَا كَانَ لَا يَدْرِي مَا يَقُولُ يَقَعُ طَلَاقُهُ وَإِلَّا فَلَا حَاجَةَ إلَى الْأَخْذِ بِقَوْلِهِمَا إنَّك اسْتَثْنَيْت، وَهَذَا مُشْكِلٌ جِدًّا، وَإِلَّا أَنْ يُجَابَ بِأَنَّ الْمُرَادَ بِكَوْنِهِ لَا يَدْرِي مَا يَقُولُ أَنَّهُ لِقُوَّةِ غَضَبِهِ قَدْ يَنْسَى مَا يَقُولُ وَلَا يَتَذَكَّرُهُ بَعْدُ، وَلَيْسَ الْمُرَادُ أَنَّهُ صَارَ يَجْرِي عَلَى لِسَانِهِ مَا لَا يَفْهَمُهُ أَوْ لَا يَقْصِدُهُ إذْ لَا شَكَّ أَنَّهُ حِينَئِذٍ يَكُونُ فِي أَعْلَى مَرَاتِبِ الْجُنُونِ، وَيُؤَيِّدُهُ هَذَا الْحَمْلُ أَنَّهُ فِي هَذَا الْفَرْعِ عَالِمٌ بِأَنَّهُ طَلَّقَ وَهُوَ قَاصِدٌ لَهُ، لَكِنَّهُ لَمْ يَتَذَكَّرْ الِاسْتِثْنَاءَ لِشِدَّةِ غَضَبِهِ، هَذَا مَا ظَهَرَ لِي فِي تَحْرِيرِ هَذَا الْمَقَامِ، وَاَللَّهُ أَعْلَمُ بِحَقِيقَةِ الْمَرَامِ ثُمَّ رَأَيْت مَا يُؤَيِّدُ ذَلِكَ الْجَوَابَ، وَهُوَ أَنَّهُ قَالَ فِي الْوَلْوَالِجيَّةِ: إنْ كَانَ بِحَالٍ لَوْ غَضِبَ يَجْرِي عَلَى لِسَانِهِ مَا لَا يَحْفَظُهُ بَعْدَهُ جَازَ لَهُ الِاعْتِمَادُ عَلَى قَوْلِ الشَّاهِدَيْنِ، فَقَوْلُهُ لَا يَحْفَظُهُ بَعْدَهُ صَرِيحٌ فِيمَا قُلْنَا وَاَللَّهُ أَعْلَمُ.
