Get lost, leave this house, will that statement constitute divorce

Assalam o alaikum!

On one occasion, on my wife asking me to give her gift over and over again, I said to her the following statement to stop her from asking one thing again and again, despite I had ensured her that I will keep it mind in future to bring her the gift that she would like.

“Get lost, leave this house”.

I had no intention of divorce at the time. However, now I am worrying if this has contituted a divorce and I am also getting anxious and frequent waswasas if I had an intention to divorce her or otherwise. Please provide ruling, given above circumstances.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if the husband utters a word or a statement that has dual or multiple meanings and some of the meanings could mean divorce (talaaq), then divorce will take place only if the husband intended divorce with the word or statement. In that instance, one talaaqe-baain (irrevocable divorce) will take place, which terminates the nikaah immediately.

In the enquired situation, you did not intend divorce by saying “Get lost, leave this house”.

Hence, this does not constitute a divorce and your Nikaah is valid. [1]

This incident should serve to remind you in future that intolerance leads one to tolerate a bigger problem.

وَحُكْمُهَا أَنَّهُ لَا يَجِبُ الْعَمَلُ بِهَا إلَّا بِالنِّيَّةِ أَوْ مَا يَقُومُ مَقَامَهَا مِنْ دَلَالَةِ الْحَالِ لِأَنَّهَا غَيْرُ مَوْضُوعَةٍ لِمَا اُسْتُعْمِلَتْ فِيهِ بَلْ تَحْتَمِلُهُ وَغَيْرَهُ فَلَا بُدَّ مِنْ التَّعْيِينِ أَوْ دَلَالَتِهِ
