Is it permissible to use my mother’s money?


Assalamualikum. I am married with two children and living abroad with my husband. My husband Alhamdulilah earns well and we are financially well. My mother lives far from us in our home country. My mother visited us for the first time last year August. She brought money with her to give me for our use (me and my children’s use ex: books, toys, foods etc.). She does not want me to work as I have small children so she wanted to give me monthly some amount of money so I can use that. I don’t work but at first I was very strict not to take those money as my mom takes interest from bank but she got upset. Also I can’t tell her that I will not take money from her due to the interest money, because previously she got very upset and also very difficult to make her understand the interest issue. Eventually I took money and used it. My husband does not like that I take money from my mother. My husband forbade me but as my mother got upset I told him that I will take that money.

Recently last month my daughter got very sick. We have to stay in the hospital for one month and still she needs full recovery. We are trying to find out what are the faults of us that could cause such incident. One of them my concern is taking interest money of my mother. My mother makes fixed deposit and use the interest from that. She also has land property from that she got rent. But as far as I know the money she gave me is from the interest of the fixed deposits not from the rent.  My husband told me he will return the whole amount to her. That might be a pressure to him. I might be taken around 5000-6000 dollar from her. My question is what should we do? Should we return those money?  I bought books, clothing items, grocery, toys with her money, is it ok to use those? Should I destroy those things? She has come here, if she wants to buy us anything should we forbid her? Please let me know what should we do so Allah will be pleased with us.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if the majority of her income is halaal it is permissible to accept her money[1].

However, you state that the $5000-$6000 your mother gave was from the interest of fixed deposits. You state that you have already spent this amount, therefore you should sincerely repent to Allah Ta`ala for using this amount. You will not have to destroy the items purchased, rather give your mother something as a gift which will technically make this into a business transaction rather than a gift[2].

It appears that this problem will keep on arising, therefore we advise you explain the situation to your mother. Request her to gift you her income from the rental money.

وَلَا يَجُوزُ قَبُولُ هَدِيَّةِ أُمَرَاءِ الْجَوْرِ؛ لِأَنَّ الْغَالِبَ فِي مَالِهِمْ الْحُرْمَةُ إلَّا إذَا عَلِمَ أَنَّ أَكْثَرَ مَالِهِ حَلَالٌ بِأَنْ كَانَ صَاحِبَ تِجَارَةٍ أَوْ زَرْعٍ فَلَا بَأْسَ بِهِ؛ لِأَنَّ أَمْوَالَ النَّاسِ لَا تَخْلُو عَنْ قَلِيلٍ حَرَامٍ فَالْمُعْتَبَرُ الْغَالِبُ، وَكَذَا أَكْلُ طَعَامِهِمْ، كَذَا فِي الِاخْتِيَارِ شَرْحِ الْمُخْتَار

وَفِي الْبَزَّازِيَّةِ غَالِبُ مَالِ الْمُهْدِي إنْ حَلَالًا لَا بَأْسَ بِقَبُولِ هَدِيَّتِهِ وَأَكْلِ مَالِهِ مَا لَمْ يَتَبَيَّنْ أَنَّهُ مِنْ حَرَامٍ؛ لِأَنَّ أَمْوَالَ النَّاسِ لَا يَخْلُو عَنْ حَرَامٍ فَيُعْتَبَرُ الْغَالِبُ وَإِنْ غَالَبَ مَالَهُ الْحَرَامُ لَا يَقْبَلُهَا وَلَا يَأْكُلُ إلَّا إذَا قَالَ إنَّهُ حَلَالٌ أُورِثْتُهُ وَاسْتَقْرَضْتُهُ

اور سود لينا مسلمان سے تو مطلق حرام ہے ، اور کفار سے لینا بعض علماء کی نزدیک حرام ہے، مگر جب وہ قلیل ہے اور زیادہ آمدنی بے سودی ہے، تو ملازم کی دکان کا تنخواہ لینا جائز ہے جبکہ تنخواہ مال مخلوط سے دی جاۓ۔ اس طرح جب اشیاء حلال زیادہ ہیں تو غلبہ حلال کو ہے (امداد الاحکام،ج3،ص533، مکتبہ دار العلوم کراچی)

و قال الشيخ دام ظله: إذا اعطي الموجز الاجرة من المال المخلوط و الاجير عالم بالخلط, فكيف يجوز له أخذها, و الخبث قد تمكن بها الخلط . قلت : هذا علي قولها . و هو الاحوط. و لكن علي قول ابي حنيفة فالخلط مستهلك – فان قيل هذا يفيد ملكه لاجل استمتاعه به- قلت: عبارات الفتاوي تدل علي الاستمتاع أيضا علي قوله (امداد الاحکام،ج3،ص534، مکتبہ دار العلوم کراچی)

مِنْ الْكَرَاهَةِ: غَلَبَ عَلَى ظَنِّهِ أَنَّ أَكْثَرَ بُيُوعَاتِ أَهْلِ السُّوقِ لَا تَخْلُو عَنْ الْفَسَادِ فَإِنْ كَانَ الْغَالِبُ هُوَ الْحَرَامَ تَنَزَّهَ عَنْ شِرَائِهِ، وَلَكِنْ مَعَ هَذَا لَوْ اشْتَرَاهُ يَطِيبُ لَهُ، (انْتَهَى) .

قَوْلُهُ: وَلَكِنْ مَعَ هَذَا لَوْ اشْتَرَاهُ يَطِيبُ لَهُ، وَوَجْهُهُ أَنَّ كَوْنَ الْغَالِبِ فِي السُّوقِ الْحَرَامَ لَا يَسْتَلْزِمُ كَوْنَ الْمُشْتَرَى حَرَامًا؛ لِجَوَازِ كَوْنِهِ مِنْ الْحَلَالِ الْمَغْلُوبِ، وَالْأَصْلُ الْحِلّ

جہاں تک حرام مال سے تنخواہ ملنے کا تعلق ہے، اس کے بارے میں شریعت کا اصول یہ ہے کہ اگر ایک مال حرام اور حلال سے مخلوط ہو اور حرام مال زیادہ ہو تو اس سے تنخواہ یا ہدیہ لینا جائز نہیں، لیکن اگر حرام مال کم ہو تو جائز ہے، بینک کی صورت حال یہ ہے کہ اس کا مجموعی

بدکار عورت نے حرام مال سے زمین خریدی ہے اس کو قران شریف کے عوض ہبہ کرنا درست ہے یا نہیں؟

زن کاسبہ نے مال حرام سے جو زمین خریدی تھی اسکی وہ مالک ہو گئ مگر خباثت اور براںی اس میں ضرور ہے پھر جب اس زمین کو ھبہ کیا تو موھوب لہ یا مشتری اسکا مالک ہو گیا، اس میں قرآن شریف کی معاذ اللہ نہیں ہے، اور اس زمین کے ہبہ یا بیع کر نے کے لیے کسی حیلے کی ضرورت نہیں ہے –
