Can a Shafi (mazur) lead a Hanafi in prayer

Assalamoalaikum Wa Rehmatullah Wa Baraktuho Mufti Sahab,

I am presenting a situation followed by questions:

Two person live together in a house. Person A is Shafii. Person B is Hanafi.
Recitation of Quran and knowledge of the Masail of Salaah of Person A is far better than Person B.

Person A is better than Person B in all Islamic aspect like fear of Allah SWT, guarding his eyes, following Sunnah and Quran, charity work, work of Dawat, memorization of Quran, etc.

But person A is a Ma’azur, “Urine drops keep coming for him”. But as he is Shafii, and in Shafii a Ma’azur person can lead the salah.

Person B is not a Ma’azur in terms of urine drops but being an Indian, he is having difficulty in pronouncing few letters like “Dha” etc.

Now the question is:

1) If we have to pray Salah in Jamaat, then who should become Imaam.

2) If person A becomes Imaam, then as he is Shafii, and as per shafii a Ma’azur can be an Imaam, hence whether person B Salaah will be valid behind him or not, considering the fact that Person A Salah is valid as per Shafii.

3) If Person B becomes Imaam, and if he mispronounce few letters like “Dha”, but in his heart he know the actual word that he is pronouncing then in this case whether Person B Salah will be valid or not..??

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

  1. A person who is not able to remain pure for such a time in which he can make wudhu and perform salah without his wudhu breaking is regarded as a mazur[1]. According to the Hanafi School, a mazur person cannot lead the salah of those who are not mazur.  Therefore, the mazur should not lead the salah.
  2. The salah of person B will not be valid behind person A as long as he is a mazur[2]
  3. The salah will be valid as long as the meaning is not changed in such a manner that it invalidates the salah[3]. Person B should endeavour to correct his tajweed.

(طاهر بمعذور) توضأ مع العذر أو طرأ عليه بعده أما لو توضأ وصلى خاليًا عنه كان في حكم الطاهر قيد بالطاهر لأن اقتداء المعذور بمثله صحيح

معذور کا اقتداء طاہر کو کسی طرح جائز نہیں، ہاں! طاہر کا اقتداء معزور کو جائز ہے (فتاوی محمودیۃ، ج6، ص284 )

جس وقت وہ معذور ہو گا اس وقت امام امام تندرستوں کا نہیں ہو سکتا اس وقت امامت اس کی بوقت عذر بالکل ناجائز ہے (عزیز الفتاوی، ص202 )

اگر اس سے بہتر امامت کے لائق، قرآن کریم کو صحیح پڑہنے والا موجود ہو تو اس غلط پڑہنے والے کو امام بنانا درست نہیں، اس کو علیحدہ کر کے دوسرے کو امام بنایا جاۓ کہ مخارج صحیح نہ ہو نے کی بنا پر معنی بگڑ کر نماز فاسد ہو نے کا قوی اندیشہ ہے اور اس کے ذمہ واجب ہے کہ مخارج کی تصحیح میں کو شش کرے (فتاوی محمودیۃ، ج6، ص364-365 )

اگر یہ عالم اپنی قدرت کے موافق تصحیح حروف میں سعی کر چکا پہر بہی صحیح پرہنے پر قادر نہیں ہوا، یا اس کی زبان میں علت ہے جس کی وجہ سے وہ صحیح پڑہنے پر معزور ہیں، ان صورتوں صحیح پرہنے والے کی نماز اس کے پیچہے درست ہو جاۓ گی، اور اگر اس نے سعی نہیں کی، نہ اس کی زبان میں علت ہیں، تو اس کے پیچہے صحیح قرآن پڑہنے والے کی نماز درست نہیں، اس صورت میں اس نماز کا اعادہ واجب ہے  جو اس کے پیچہے پڑہی گئ ہو (امداد الاحکام، ج1، ص514 )
اصل حرف ضاد ہے اس کو اصلی مخرج سے ادا کرنا واجب ہے اگر نہ ہو سکے تو بحالت معذوری دال پڑ کی صورت سے بہی نماز ہو جاوے گی (فتاوی رشدیۃ، ص330 )
