Wife says husband said talaaq, talaaq, talaaq, and he claims he said, talaaq, talaaq, tilaa

During an argument between a couple the wife said to the husband “why don’t you divorce me then.”

The husband replied angrily “you want a divorce, talaaq, talaaq, talaaq.”

The wife claims she heard the words talaaq clearly three times.

The husband denies this saying he said talaaq, talaaq, tilaa. 

He claims he mentioned the word talaaq twice only and once the word tilaa.

In the Name of Allah, the Most Gracious, the Most Merciful.

 Assalāmu ‘alaykum wa rahmatullāhi wa barakātuh

Even according to the version of the husband, three talāqs have taken place and the nikāh has permanently terminated.[1]

[1] ولو حذف القاف من طالق فقال أنت طال فإن كسر اللام وقع بلا نية وإلا فإن كان في مذاكرة الطلاق أو الغضب فكذلك وإلا توقف على النية وإن حذف اللام فقط فقال أنت طاق لا يقع وإن نوى وإن حذف اللام والقاف بأن قال أنت طا وسكت أو أخذ إنسان فمه لا يقع وإن نوى كذا في البحر الرائق (الفتاوى الهندية، دار الكتب العلمية، ج١ ص٣٩١)

وكذا (يقع الطلاق بقوله) يا طال بكسر اللام وضمها لأنه ترخيم أو أنت طال بالكسر وإلا توقف على النية قال الشامي: أي فإنه يقع بلا نية بخلاف أنت طاق بحذف اللام فلا يقع لأن حذف آخر الكلام معتاد عرفا تاترخانية (رد المحتار، دار عالم الكتب، ج٤ ص٤٦٨)

وأما الطلاق فيقع بها إلخ أي بالألفاظ المصحفة كتلاق وتلاك وطلاك وطلاغ وتلاغ، قال فى البحر: فيقع قضاء ولا يصدق إلا إذا أشهد على ذلك قبل التكلم بأن قال: إمرأتي تطلب مني الطلاق وأنا لا أطلق فأقول هذا، ولا فرق بين العالم والجاهل، وعليه الفتوى (رد المحتار، دار عالم الكتب، ج٤ ص٨٥)

ولو قال: أنت طلاق يقع الطلاق به ولا يحتاج فيه إلى النية (الفتاوى الهندية، دار الكتب العلمية، ج١ ص٣٨٩)
