Can a brother refuse his share of a father’s wealth if he’s deceased?

Asalamualaykum Mufti Sahab, My father expired 11 years ago. My mother is alive and we in all are 3 sisters and 3 brothers. One brother is refusing to take any share in our fathers wealth. He says he does not want it. What do we do with it? Can he refuse it?

Answer

(Fatwa: 1629/1629/M=1430)

If any heir does not want his share from inheritance i.e. he doesn’t need it, then he should not refuse it, he should take his share then present it to someone and give in his/her possession.
