Is my wife exempted from kafara and qada for having intercourse after Sehri?

Answered as per Hanafi Fiqh by IslamicSolutions.org

Shortened Question:

Is my wife exempted from kafara and qada for having intercourse after Sehri?

Does ejaculation while kissing, after dawn during Ramadan breaks the Fast?

Will kafara and qada be necessary?

Question:

Thanks for your speedy response. Will my wife be exempted (for having intercourse after Sehri) and will kafara and qada also be wajib upon her?

If by merely kissing after dawn during Ramadan one ejaculates, is his fast broken?

Will that person have to pay kafara and qada?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The same rule of paying kafara and qada will also apply to your wife.

Kissing will break the fast if one swallows the saliva of his or her partner. Kafara and qada will become Wajib on both partners. (Bahishti Zewar – Moulana Ashraf Ali Thanwi (RA) Vol. 1; Pg 336)

Ejaculation without consuming saliva will not break the fast. The wudu will be broken and ghusl will become compulsory. (Bahishti Zewar – Moulana Ashraf Ali Thanwi (RA) Vol. 1; Pg 72)
