Are cherries preserved in red wine permissible to consume?

Question:

Salaam Shaykh, there is a debate going on regarding cherries preserved in red wine.  Some people are saying if you wash the cherries they will be halal to eat? Please clarify.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Cherries preserved in red wine absorb the red wine and are mixed with red wine. Red wine is impure as a substance and unlawful to consume. As a result, the cherries become impure and unlawful to consume due to absorbing the red wine.[1]

[1]   وَإِذَا عَجَنَ الدَّقِيقَ بِالْخَمْرِ وَخَبَزَهُ لَا يُؤْكَلُ، وَلَوْ أَكَلَ لَا يُحَدُّ.

وَكَذَلِكَ لَوْ وَقَعَتْ الْحِنْطَةُ فِي الْخَمْرِ لَا تُؤْكَلُ قَبْلَ الْغَسْلِ فَإِنْ غُسِلَتْ وَطُحِنَتْ أَوْ لَمْ تُطْحَنْ، وَلَمْ تُوجَدْ رَائِحَةُ الْخَمْرِ، وَلَا طَعْمُهَا فَلَا بَأْسَ بِأَكْلِهِ قِيلَ: هَذَا إذَا لَمْ تَنْتَفِخْ الْحِنْطَةُ، أَمَّا إذَا انْتَفَخَتْ فَعَلَى قَوْلِ مُحَمَّدٍ – رَحِمَهُ اللَّهُ تَعَالَى -: لَا تَطْهُرُ أَبَدًا وَعَلَى قَوْلِ أَبِي يُوسُفَ – رَحِمَهُ اللَّهُ تَعَالَى -: تُغْسَلُ ثَلَاثَ مَرَّاتٍ، وَتُجَفَّفُ فِي كُلِّ مَرَّةٍ، وَتُؤْكَلُ.

وَعَلَى هَذَا إذَا طُبِخَ اللَّحْمُ فِي الْخَمْرِ، فَعَلَى قَوْلِ مُحَمَّدٍ – رَحِمَهُ اللَّهُ تَعَالَى – لَا يَحِلُّ أَكْلُهُ أَبَدًا، وَعَلَى قَوْلِ أَبِي يُوسُفَ – رَحِمَهُ اللَّهُ تَعَالَى – يُغْلَى ثَلَاثَ مَرَّاتٍ بِمَاءٍ طَاهِرٍ وَيُبَرَّدُ فِي كُلِّ مَرَّةٍ كَذَا فِي الْمُحِيطِ.

وَإِذَا طُرِحَ الْخَمْرُ فِي مَرَقٍ بِمَنْزِلَةِ الْخَلِّ وَطُبِخَ لَا يُؤْكَلُ؛ لِأَنَّ هَذَا مَرَقٌ نَجِسٌ، وَلَوْ حِسًّا مِنْهُ لَا يُحَدُّ مَا لَمْ يُسْكِرْ. (الهندية ج 5 ص 411 الرشيدية)
