Exhuming the body of a non-Muslim found in a Muslim graveyard

Answered as per Hanafi Fiqh by TheMufti.com

Q. If a non-Muslim grave is found buried in a Muslim graveyard, does the Muslim community have to exhume the body of the non-Muslim?

A. All efforts should be made in ensuring that a non-Muslim is not buried in a Muslim graveyard. In an instance where a non-Muslim is buried in a Muslim graveyard due to an oversight etc., the grave of a non-Muslim will not have to be exhumed. It should simply be identified by separating it with a wall or a structure from the graves of Muslims.
