Asking the husband for khula

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: Can a khula take place if the reason for khula is that the life style of groom and bride are not the same. And the bride doesn’t ask for khula directly to her husband i.e groom instead it was asked to the grooms parents?

Bismillaah

A:

1. If the wife cannot continue with the nikaah and she feels that she will not be able to fulfil her marital obligations and responsibilities towards her husband, it will be permissible for her to seek khula from her husband.

2. The khula is subject to the husbands acceptance. Hence, if the husband accepts the khula, the khula will be valid.

And Allah Ta’ala (الله تعالى) knows best.
