Can I Give my Share to Someone Else When Inheriting?

Answered as per Hanafi Fiqh by Seekersguidance.org

Answered by Shaykh Faraz Khan

Question: My mom passed away recently. Her past employer said that she had some money left. I understand that the division of her estate per Islamic law is greater for the son. I was wondering if I could give the money to my sisters, and each of us can have an equivalent amount. I am willingly doing this with no compulsion.

Would this be alright?

Answer: Assalamu alaikum wa rahmatullah,

I pray this finds you in the best of health and states. Please pardon me for the delay in answering your question.

It is perfectly valid to gift all or part of your share to another, such as a sibling, so long as there is no explicit or implicit coercion to do so (which, as you stated, is your situation). [Maydani, Lubab]

In the case you described, it would be fine to have the past employer distribute the money as you desire, such that the money is gifted to your siblings.

And Allah knows best.

wassalam
