Masbooq (latecomer) joining the Imaam before Salaam

Q: Whilst performing Salaah with Jamaat behind an Imaam, if a Masbooq (latecomer) joins the Salaah after the Imaam has completed four rakaats and joins just before the Salaam.

1. Is it necessary for him to recite the tashahhud with the Imaam for his Salaah to be valid or is it sufficient for his Salaah to be valid that he joins in the Salaah before the Imaam makes salaam?

2. Should the Masbooq recite only Tashahud in the Qa’dah or also Durood Ibraaheem and Duaa after Durood.

Bismillaah

A:

1. If he sits down in tashahud before the Imaam makes salaam, his joining will be valid.

2. It is permissible for him to recite tashahud, Durood-e-Ebrahim and Dua.

And Allah Ta’ala (الله تعالى) knows best.

(ولفظ السلام ) مرتين فالثاني واجب على الأصح برهان دون عليكم وتنقضي قدوة بالأول قبل عليكم على المشهور عندنا وعليه الشافعية خلافا للتكملة

قال الشامي : ( قوله وتنقضي قدوة بالأول ) أي بالسلام الأول قال في التجنيس الإمام إذا فرغ من صلاته فلما قال السلام جاء رجل واقتدى به قبل أن يقول عليكم لا يصير داخلا في صلاته لأن هذا سلام (رد المحتار 1/ 468)

 ولو فرغ المؤتم قبل إمامه سكت اتفاقا وأما المسبوق فيترسل ليفرغ عند سلام إمامه وقيل يتم وقيل يكرر كلمة الشهادة

قال الشامي : ( قوله فيترسل ) أي يتمهل وهذا ما صححه في الخانية وشرح المنية في بحث المسبوق من باب السهو وباقي الأقوال مصحح أيضا قال في البحر وينبغي الإفتاء بما في الخانية كما لا يخفى ولعل وجهه كما في النهر أنه يقضي آخر صلاته في حق التشهد ويأتي فيه بالصلاة والدعاء وهذا ليس آخرا قال ح وهذا في قعدة الإمام الأخيرة كما هو صريح قوله ليفرغ عند سلام إمامه وأما فيما قبلها من القعدات فحكمه السكوت كما لا يخفى اه ومثله في الحلية ( قوله وقيل يكرر كلمة الشهادة ) كذا في شرح المنية والذي في البحر والحلية والذخيرة يكرر التشهد تأمل (رد المحتار 1/ 511)
