Who is responsible for the damages of a borrowed car?

Q. Please advise me, if i lend my car to a friend or family member and he unintentionally damages it in any way, be it an accident or the engine blowing etc., who is liable to fix it or pay for the damages? 


A. If you had given full permission to your friend or family member to use your car and it incurred damages, then if it was due to the negligence of your friend or family member i.e. exceeding the speed limit and driving irresponsibly etc. , he/she will be responsible for the cost of the damages of your car. However, if it was not due to their negligence, they will not be responsible for it. (Hindiyyah 4/363)
