What is the Islamic legal verdict on the taking out of a 403K?

In the name of Allah the Inspirer of truth

Since a 403k plan is similar to a 401k plan, the details below on 401k investments will apply.

It is not permissible to enroll into such a plan if there are no lawful investments options offered. This prohibition stands even if the intention is to dispose of the interest and unlawful gain later and keep the capital and the amount matched by the company.

One can instead request the investment company to include lawful funds such as the Dow Jones Islamic Index as part of their 403k offerings in which one can then invest.
