Zakaah Queries: Debt Settlement, Bad Debt, and More

Q: Could the Respected Scholar kindly explain the following Zakaah queries:

  1. Some poor (zakaah liable) individuals are owing us money (R1000). Can we settle their debt (R1000) as a payment for our Zakaah and exclude the amount (R1000) from our total Zakaah?
  2. If the above is permissible, do we have to inform the liable debtors that they can keep the loan amount (1000) as Zakaah, and the debt is settled?
  3. If No.1 is permissible, are there any other conditions, requirements etc.?
  4. If No.1 is not permissible, what should be done and how will it effect our Zakaah?
  5. How and when is Bad Debt Defined for Zakaah?
  6. What’s the ruling for Bad Debt?
  7. Is it correct to say and understand; that if we don’t Qualify to  pay Zakaah, then we Qualify to receive Zakaah?
  8. Does owning a House (personal not commercial), Car disqualify one from receiving Zakaah, even though one does not qualify to pay Zakaah?
  9. How does an Interest (Allah Ta’ala forgive us and make its repayment as fast as possible) loan effect the Zakaah? And how is it deducted etc.?
  10. What’s the Status of the Zakaah given to an individual which one was certain is liable, only to find out he is not? Is the Zakaah fulfilled? Is repayment necessary?

A: 

1. No.

4. You would discharge your zakaat with your own wealth and request the debtor to pay your debts first.

5. When there is no possibility of you recovering your debt then this is a bad debt.

6. A bad debt is not zakaatable.

7. This is not a general law. The one who is in need should accept zakaat. Zakaat will be discharged by giving to one who does not qualify to pay zakaat, but he himself should see whether he is in need or not.

8. No.

9. It does not affect zakaat.

10. Zakaat is valid.

And Allah Ta’ala (الله تعالى) knows best.

واعلم أن أداء الدين عن الدين والعين عن العين وعن الدين يجوز وأداء الدين عن العين وعن دين سيقبض لا يجوز وحيلة الجواز أن يعطي مديونه الفقير زكاته ثم يأخذها عن دينه ولو امتنع المديون مد يده وأخذها لكونه ظفر بجنس حقه فإن مانعه رفعه للقاضي (شامي 2/271)

ويشترط أن يكون الصرف ( تمليكا ) لا إباحة كما مر ( لا ) يصرف ( إلى بناء ) نحو ( مسجد و ) لا إلى ( كفن ميت وقضاء دينه ) أما دين الحي الفقير فيجوز لو بأمره ( شامى 2/344 )

(فلا زكاة على مكاتب)…(ودين) كان (جحده المديون سنين) ولا بينة له عليه (ثم) صارت له بأن (أقر بعدها عند قوم) وقيده في مصرف الخانية بما إذا حلف عليه عند القاضي أما قبله فتجب لما مضى (وما أخذ مصادرة) أي ظلما (ثم وصل إليه بعد سنين) لعدم النمو والأصل فيه حديث علي لا زكاة في مال الضمار وهو ما لا يمكن الانتفاع به مع بقاء الملك (ولو كان الدين على مقر مليء أو) على (معسر أو مفلس) أي محكوم بإفلاسه (أو) على ( جاحد عليه بينة) وعن محمد لا زكاة وهو الصحيح ذكره ابن ملك وغيره لأن البينة قد لا تقبل (أو علم به قاض) سيجيء أن المفتى به عدم القضاء بعلم القاضي (فوصل إلى ملكه لزم زكاة ما مضى) وسنفصل الدين في زكاة المال (شامي 2/266)

باب المصرف  أي مصرف الزكاة والعشر وأما خمس المعدن فمصرفه كالغنائم ( هو فقير وهو من له أدنى شيء ) أي دون نصاب أو قدر نصاب غير تام مستغرق في الحاجة

و قال في رد المحتار : قوله ( مستغرق في الحاجة ) … والحاصل أن النصاب قسمان موجب للزكاة وهو النامي الخالي عن الدين وغير موجب لها وهو غيره فإن كان مستغرقا بالحاجة لمالكه أباح أخذها وإلا حرمه وأوجب غيرها من صدقة الفطر والأضحية ونفقة القريب المحرم كما في البحر وغيره ( رد المحتار 2/339)
