Wife demanding mahr after asking for a divorce

Q: There is a couple who are separated for nearly two years, and recently they divorced – now the wife asked for divorce. I want to know if the husband has to pay her anything, like mehr money, as the wife demanded mehr money and some others. Is it right? does the husband have to pay even if the wife divorces the husband?

A: If the mahr was not given at the time of nikaah it should be given to her now.

باب المهر … ( وتجب ) العشرة ( إن سماها أو دونها و ) يجب ( الأكثر منها إن سمى ) الأكثر ويتأكد ( عند وطء أو خلوة صحت ) من الزوج ( أو موت أحدهما ) أو تزوج ثانيا في العدة …

قال الشامي في رد المحتار : ( ويتأكد ) أي الواجب من العشرة أو الأكثر وأفاد أن المهر وجب بنفس العقد لكن مع احتمال سقوطه بردتها أو تقبيلها ابنه أو تنصفه بطلاقها قبل الدخول وإنما يتأكد لزوم تمامه بالوطء ونحوه وبه ظهر أن ما في الدرر من أن قوله عند وطء متعلق بالوجوب غير مسلم كما أفاده في الشرنبلالية قال في البدائع وإذا تأكد المهر بما ذكر لا يسقط بعد ذلك وإن كانت الفرقة من قبلها لأن البدل بعد تأكده لا يحتمل السقوط إلا بالإبراء كالثمن إذا تأكد بقبض المبيع (رد المحتار 3/ 102)
