Q: I just wanted to know that if a property is gifted strictly for the purpose of a graveyard, can the caretakers build a shopping complex on that particular land?

Building on a Land Given For a Graveyard

A: If the property was given as waqf for building a graveyard then it will be impermissible to build a shopping complex on that land. If the land was donated without being given as waqf, then if there is a need for building a graveyard, the land should be used for a graveyard. However if there is no need for a graveyard, it will be permissible for the caretakers (with the permission of the contributors) to build a shopping complex and use the proceeds for a graveyard and other related matters.

Q: YesterdayI asked you a question about a graveyard in waqf property. Is it permissible for the caretakers of the waqf property to construct shops and a madrasa on the land which is donated only for the purpose of graveyard? Even the government records shows it is a graveyard. Are the shops and madrasa permissible on this land or does it have to be demolished?

A: If the land was given as waqf solely for building a graveyard then it will be impermissible to build a shopping complex or madrasah on that land.

( فإذا تم ولزم لا يملك…)

قال الشامي: قوله ( لا يملك ) أي لا يكون مملوكا لصاحبه ولا يملك أي لا يقبل التمليك لغيره بالبيع ونحوه (رد المحتار 4/352)

وفي الإسعاف ولا يجوز له أن يفعل إلا ما شرط وقت العقد … وفي فتاوى الشيخ قاسم وما كان من شرط معتبر في الوقف فليس للواقف تغييره ولا تخصيصه بعد تقرره ولا سيما بعد الحكم فقد ثبت أن الرجوع عن الشروط لا يصح (رد المحتار 4/459-460)

( اتحد الواقف والجهة … جاز للحاكم أن يصرف من فاضل الوقف الآخر عليه ) لأنهما حينئذ كشيء واحد ( وإن اختلف أحدهما بأن بنى رجلان مسجدين ) أو رجل مسجدا ومدرسة ووقف عليهما أوقافا ( لا ) يجوز له ذلك (الدر المختار 4/360)
