Can I Apply for Khula Without My Parents Knowing?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: If I got married without letting my parent’s know, can I apply for khula without their knowledge? Me and my husband don’t live together. We only meet each other once a week. That kind of relationship has not happened and I am still a virgin. In this case, can I just give him divorce or he has the right of not giving the permission of divorce?

Do I have to sit for iddah? What is the procedure of khulah? We don’t have any similarities between us in case of deen or any other thing. Emotionally I suffered a lot in this 9 years of relationship. If I go further, it can affect my mental health very badly. I tried to be patient and it did go well for a few days but at the end it is the same. Please tell me the procedure of khulah in details and do I have to involve anyone else in this matter or not?

Bismillaah

A: He has the right to issue a divorce. You do not have the right to issue a divorce.

If he issues a divorce you will have to sit in iddah since you have been meeting with each other.

And Allah Ta’ala (الله تعالى) knows best.
