Waiters not receiving a salary

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: In a Muslim fast food establishment like Ocean Basket, Fego, Adegah, etc. they do not pay the staff wages. They survive on tips of the customers, if the customers tip them. Is this permissible in Islam.

Bismillaah

A: If the waiters are working voluntarily and they are quite happy without taking any type of remuneration and they do not complain nor do they demand and request and they are quite comfortable with this arrangement then it is permissible.

And Allah Ta’ala (الله تعالى) knows best.
