Q: If a person passes away at sea, what should be done? What is the ruling regarding Ghusal, Janaazah Salaah and burial? Can the deceased be placed in cold storage (e.g. cold room) so that on reaching the coast, after one or two months, they can bury him on land?
A: If a person passes away in a ship and the coast is so far away that there is a fear of the corpse beginning to decompose before reaching the coast, then in such a case ghusal and kafan should be given to him and the Janaazah Salaah should be performed. Thereafter, he will be lowered into the sea. When lowering the body into the sea, the body will be tied to a heavy object (stone, etc) so that the body sinks to the bed of the sea and does not float above the water. However, if the coast is near and there is hope of reaching land without the corpse decomposing, the corpse should be left aside so that it can be buried upon reaching land.

مات في سفينة غسل وكفن وصلي عليه وألقي في البحر إن لم يكن قريبا من البر
قال الشامي : قوله ( إن لم يكن قريبا من البر ) الظاهر تقديره بأن يكون بينهم وبين البر مدة يتغير الميت فيها ثم رأيت في نور الإيضاح التعبير بخوف الضرر به (رد المحتار 2/235)
( ومن مات في سفينة وكان البر بعيدا وخيف الضرر ) به ( غسل وكفن ) وصلى عليه ( وألقي في البحر ) وعن الإمام أحمد بن حنبل رحمه الله يثقل ليرسب وعن الشافعية كذلك إن كان قريبا من دار الحرب والأشد بين لوحين ليقذفه البحر فيدفن
قال الطحطاوي : قوله ( وخيف الضرر به ) أي التغير أما إذا لم يخف عليه التغير ولو بعد البر أو كان البر قريبا وأمكن خروجه فلا يرمي كما يفيده مفهومه والظاهر عليه حرمة رميه وحرره نقلا قوله ( وألقى في البحر) مستقبل القبلة على شقه الأيمن ويشد عليه كفنه وقوله ليرسب أي ليثبت في قعر البحر وفي القاموس رسب في الماء كنصر وكرم رسوبا ذهب سفلا (حاشية الطحطاوي على مراقي الفلاح ص613)
