Fasting on the 9th and 10th or the 10th and 11th of Muharram

Q: Please advise if the two Muharram fasts can be split as follows, ninth and eleventh?

Bismillaah

A: The tenth of Muharram is the day of Aashura. The virtues of Aashura mentioned in the Hadith are for the one who fasts on the ninth and tenth or the tenth and eleventh of Muharram. We should thus fast on the ninth and tenth or on the tenth and eleventh of Muharram. If one fasts on the ninth and eleventh and does not fast on the tenth, he will not receive the virtues of fasting on the day of Aashura though his fasts will be valid.

And Allah Ta’ala (الله تعالى) knows best.

عن ابن عباس رضي الله عنهما قال قال رسول الله صلى الله عليه وسلم صوموا يوم عاشوراء وخالفوا فيه اليهود صوموا قبله يوما أو بعده يوما (السنن الكبرى للبيهقي رقم 8667)

( ونفل كغيرهما ) يعم السنة كصوم عاشوراء مع التاسع

قال الشامي في رد المحتار : قوله ( يعم السنة ) قدمنا في بحث سنن الوضوء تحقيق الفرق بين السنة والمندوب وأن السنة ما واظب عليها النبي أو خلفاؤه من بعده وهي قسمان سنة الهدى وتركها يوجب الإساءة والكراهة كالجماعة والأذان وسنة الزوائد كسير النبي في لباسه وقيامه وقعوده ولا يوجب تركها كراهة والظاهر أن صوم عاشوراء من القسم الثاني بل سماه في الخانية مستحبا فقال ويستحب أن يصوم يوم عاشوراء بصوم يوم قبله أو يوم بعده ليكون مخالفا لأهل الكتاب ونحوه في البدائع بل مقتضى ما ورد من أن صومه كفارة للسنة الماضية وصوم عرفة كفارة للماضية والمستقبلة كون صوم عرفة آكد منه وإلا لزم كون المستحب أفضل من السنة وهو خلاف الأصل تأمل (رد المحتار 2/374)

و كره بعضهم صوم يوم عاشوراء و حده لمكان التشبه باليهود و لم يكرهه عامتهم لأنه من الأيام الفاضلة (بدائع الصنائع 2 /79)
