Can percentage of business proceeds be fixed as the rent?

Question

Is it permissible to give a shop on rent and charge the tenant a certain percentage of the proceeds or turnover of the business? For example, 10% of the turnover, so if in December the turnover was $15000, the rent for that month would be $1500. Is this permissible?

Answer

The monthly rental amount should be agreed in advance as a fixed amount. It cannot be based on the percentage of profits or the turnover. It is not known with certainty how much the turnover of a business will be in a particular month and this could therefore lead to disputes. This must therefore be avoided.

عن أبي هريرة قال: نهى رسول الله صلى الله عليه وسلم عن بيع الحصاة وعن بيع الغرر. رواه مسلم (١٥١٣). وعن أبي هريرة أن رسول الله صلى الله عليه وسلم نهى عن الملامسة والمنابذة، رواه البخاري (٢١٤٦).  وعن جابر بن عبد الله أن رسول الله صلى الله عليه وسلم نهى عن المحاقلة والمزابنة والمخابرة، رواه مسلم (١٥٣٦) وفيه: والمخابرة: الثلث والربع وأشباه ذلك، انتهى. وقال محمد في الأصل (٣/٤٦٦): وإذا استأجر الرجل دارا بدراهم مسماة كل شهر فهو جائز، وكذلك الدنانير، وكذلك الفلوس، وكذلك الذهب التجر بعد أن يسمي جيدا أو رديئا أو وسطا، وكذلك الفضة التبر، وكذلك كل كيل يستأجر به دارا أو بيتا وسمى الكيل ونوعه وصفته، وكذلك الوزن. وإن ترك شيئا من هذا لم يسمه فسدت الإجارة. قال (٤/٤١٤): وإذا استأجر الرجل أرضا وشرط على صاحبها أن يكون له ما فيها من الزرع إذا انقضت الإجارة، فإن هذا فاسد لا يجوز، لأنه مجهول، انتهى. وقال القدوري في مختصره (ص ١٠١): ولا تصح حتى تكون المنافع معلومة والأجرة معلومة، وما جاز أن يكون ثمنا في البيع جاز أن يكون أجرة في الإجارة، انتهى۔
