Question

Islamically, is it legal to sell on eBay?

Answer

It is permissible to sell on eBay, whether it is a fixed price or via auction, as long as the purchaser has the right to return the product upon sight and the product is reasonably described.

قال محمد في الجامع الصغير (ص ٣٤١) عن يعقوب عن أبي حنيفة: رجل اشترى طعاما لم يره وقال: قد رضيته، ثم رآه فلم يرضه، فله أن يرده، انتهى. وقال القدوري في مختصره (ص ٧٨): وإذا حصل الإيجاب والقبول لزم البيع ولا خيار لواحد منهما إلا من عيب أو عدم رؤية. وقال (ص ٨١): ومن اشتر شيئا لم يره فالبيع جائز، وله الخيار إذا رآه، إن شاء أخذه وإن شاء ردَّه، انتهى۔
