Inheritance Shares Query

A person passes away and only leaves behind one full brother, one paternal brother (half brother with the same father) and one maternal brother (half brother with the same mother). How will the inheritance be distributed?

Answer

The maternal brother will receive one sixth, the full brother will receive the remaining five sixth. The paternal brother is not entitled to any share.

قال علي وزيد رضي الله عنهما: لا يرث أخ لأب مع أخ لأب وأم شيئا. وقالا: ولا ينقص الأخ الواحد من الأم أو الأخت الواحدة من الأم من السدس، وإن اجتمع أخ وأخت لأم أو أكثر من ذلك فلهم الثلث، لا يزادون عليه وإن كثروا. والذكر والأنثى فيه سواء لقول الله تعالى في كتابه: فهم شركاء في الثلث. نقله محمد في الأصل (٦/١٧، طبعة قطر) ثم قال: وتفسير ذلك: رجل مات وترك أخاه فله المال كله. فإن ترك أخاه لأبيه وأمه وأخاه لأبيه فالمال للأخ من الأب والأم، وسقط الأخ من الأب. فإن ترك أخا لأم وأخا لأب وأم فللأخ من الأم السدس، وما بقي فللأخ من الأب والأم. فإن ترك ثلاثة إخوة متفرقين أخا لأب وأم وأخا لأب وأخا لأم فللأخ من الأم السدس، وما بقي فللأخ من الأب والأم، وسقط الأخ من الأب. فإن ترك أخوين لأم وأخوين لأب وأم فللأخوين من الأم الثلث، وما بقي فللأخوين من الأب والأم، انتهى مختصرا۔
