Changing loan into Zakat

I have loaned some money to a person who is poor. Is it permissible for me to make an intention that it is now Zakat?

Answer

If the debtor returns the loaned money to the creditor who then donates the money to the debtor with the intention of Zakat, this is permissible if the debtor is poor and Zakat will be fulfilled.

If the debtor does not return the money and the creditor simply makes an intention to change his loan into Zakat, Zakat will not be fulfilled and this will be regarded as an optional donation or gift. (However, the Zakat due on the creditor on this loaned amount will be fulfilled if the debtor is poor. This is only in relation to the Zakat due on this loaned amount).

جاء في الأصل لمحمد (٢/١١٢): قلت: أرأيت الرجل يكون له الدين فيتصدق به على الذي هو عليه وينوي أن يكون من زكاة ماله هل يجزيه ذلك؟ قال: لا. قلت: فعليه أن يزكي ذلك الدين مع ماله؟ قال: لا. قلت: لم؟ قال: لأنه لم يقبضه. قلت: أرأيت إن قبضه ثم تصدق به عليه هل يجزيه ذلك؟ قال: نعم، انتهى. وقال السرخسي في المبسوط (٢/٢٠٣): قال: رجل له على آخر دين فتصدق به عليه ينوي أن يكون من زكاة ماله لا يجزئه إلا عن مقدار الدين إن كان المديون فقيرا. وقال: إذا كان الدين كله على الفقير فوهبه له أو أبرأه منه ينوي عن زكاة ذلك الدين يجزئه، لأن الواجب جزء من ذلك الدين، وقد أوصله إلى مستحقه فيجوز، انتهى. وراجع المحيط البرهاني (٢/٢٧٨)۔
