Gastroplasty surgery

I would like to know if gastroplastic surgery (the surgery where the stomach is cut in order to loose weight) is permissible. I ask the question because I had this surgery 3 yrs ago in an emergency situation and because of it I cannot fast on Ramadan.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

If gastroplasty surgery is such that it renders the patient unable to fast in Ramadan, then such a surgery will only be permissible in an emergency situation when a competent doctor says that there are no alternatives. In normal situations, such a surgery will not be permissible.

قال ابن عابدين رحمه الله: أقول: كونه يعذر بذلك ( أي أكل الثوم وغيره مما له رائحة كريهة ) ينبغي تقييده بما إذا أكل ذلك بعذر أو أكل ناسيا قرب دخول وقت الصلاة لئلا يكون مباشرا لما يقطعه عن الجماعة بصنعه ( رد المحتار: 2/526، دار المعرفة )

في مراقي الفلاح:  وكره له فعل ما ظن أنه يضعفه عن الصوم كالفصد والحجامة والعمل الشاق لما فيه من تعريض الإفساد ؛ وقال الطحطاوي رحمه الله: قوله : ( لما فيه من تعريض الإفساد ) عبارة الشرح لما فيه من تعريضه للإفساد ، والضمير للصوم وهو من إضافة المصدر إلى مفعوله ( حاشية الطحطاوي: ص 680، العلمية )
