Talaq of a Person Who Has Bipolar Disorder

Answered by: Maulana Muhammad Asadullah Anwar Adam

Question:

I had an argument with my wife after which it escalated and it led to a serious rage of anger where my wife started abusing my family and extremely vulgar language and profanity. I lost control and I had not eaten for 2 days, evidently, my blood sugar was also down. Plus I have a family history of bipolar. I too got into an extreme rage and lost my sense to the extent that I was trembling. That at that point I uttered divorce to my wife, I lost the count but it was  4 – 5 times.

Again it is important to note that I have BIPOLAR disorder + I take heavy Benzo medications as I am prone to panic attracts. I also have schizophrenia in my family with my youngest brother not lucid. I have also taken medications like Lamictal, Telox and NeuroSith by a leading psychiatrist in Karachi.

After my majnoon or extreme rage came down I immediately repented and immediately confessed that I had lost my senses and had no control over myself. It was the heat of the moment. There was no will or intention.

I would like to know if divorce has been affected or not knowing that I have 11 years of marriage and two kids with her.

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

Divorce uttered during a state of majnoon or extreme anger to the point of one losing their senses and being unable to differentiate between right and wrong does not occur [1]

In your situation divorce has not occurred.
