Is it permissible for locals to offer salah in Darul Uloom?

In the month of Ramadan in our locality some people used to offer salah in Darul Uloom knowing the fact that the one mosque is just close to it and other mosque is at 150 mts distance. Now some people told that it is not permissible for locals to offer salah in Darul Uloom it is for the people who are engaged in the Darul Uloom and the mosque of a Darul Uloom should be separate and it should not constitute a penny of zakah used for its (mosques) construction. Now please guide us in this matter?

Answer

If the mosque of Darul Uloom is not congested then local people may offer salah therein. In this case it shall not be unlawful for the local people to offer salah in it.
لو بنى مسجداً لأهل محلة وقال: جعلت هذا المسجد لأهل المحلة خاصة كان لغير أهل تلك المحلة أن يصلى فيه (عالمگیریگ 2/457‏،458)
However, this is correct and alright that a single penny of zakah cannot be used in the construction of the mosque.
