What constitutes zinaa?

According to Fatwa#: 32074 I continue to obey and please my parents but they still will not give me what I want, i communicate with my father and Mother and requested them to communicate with your husband and request a divorce or let me ask him for divorce, But they said No because they think it’s too late and they think about our inherited. They are blackmailing me emotional, one thing more that I offer my parents that if you want so I can spend my whole life in your KHADMAT will never ever marry anyone but they were still not accepting this as well I don’t know what to do.

   I swear to Allah Taala as He is Al Raheem that I do want to stop all Haram things (No TV & music etc) from now In sha Allah and I will abstain myself and my boyfriend from any communications except normal text messages in our boundaries with each other until our Nikaah In sha Allah. Me and my boyfriend want to spend life according to Quran & Sunnah  Allhamduallah he  is growing  beard according to Quran and Sunnah and I start wearing Abaya so we motivate each other Ma sha Allah now he is going to Mecca & Medina for Umra hope that Allah(J) will forgive our Sins and will helps us to get marry with each other In sha Allah. Please make dua for us JazakAllah khair

I would be grateful if you could answer to this question form previous Fatwa#: 32074

  • In Fatwa#: 32074 I asked you that the relationship me and my boyfriend had in past was that Zina?
  • In Fatwa#: 32074 you said that i should request my parents to communicate with your husband and request a divorce but as I said they are saying No to that what should I do in case now?

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

  1. The acts you performed with your boyfriend did not constitute zinaa. However, anal sex is haram. Make tawbah from that and never repeat that in the future.[1]
  2. You may talk to a senior and influential member of your family and request him to intercede on your behalf.

[1]  قال الحصكفي: والزنا الموجب للحد (وطء) وهو إدخال قدر حشفة من ذكر

قال ابن عابدين: (قوله والزنا) بالقصر في لغة أهل الحجاز فيكتب بالياء، وبالمد في لغة أهل نجد فيكتب بالألف. بدأ بالكلام عليه؛ لأنه لصيانة النسل فكان راجعا إلى الوجود وهو الأصل ولكثرة وقوع سببه مع قطعيته، بخلاف السرقة فإنها لا تكثر كثرته، والشرب وإن كثر فليس حده بتلك القطعية نهر وفتح مطلب الزنا شرعا لا يختص بما يوجب الحد بل أعم (قوله الموجب للحد) قيد به؛ لأن الزنا في اللغة والشرع بمعنى واحد، وهو وطء الرجل المرأة في القبل في غير الملك وشبهته، فإن الشرع لم يخص اسم الزنا بما يوجب الحد بل بما هو أعم، والموجب للحد بعض أنواعه.
