Is violating the law of a country a sin?

Is breaking traffic rules  like not waiting for red light is a sin in ones mother homeland (i.e  Islamic countries) and in foreign countries ?

As i have seen somewhere that when someone is granted visa so they metaphorically binds a contract with them,so if the country rules are not against shariah rules ,this person is bind by contract to obey these rules ?

And in ones own  homeland he has to obey rulers rules.

And whether in ones homeland  ,is voilation of all rules  set by rulers which are not against shariah ,a sin  ?

and same question related  in non-islamic  countries ?

I mean by sin “GUNAH or Haram” , not morally bad.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The traffic laws of a country as well as other administrative laws are designed for the safety of all people using the public roads and public utilities.

According to Shariah, when using a public utility, the safety of others is strongly considered.

Consider the following hadith:

عَنْ عَمْرِو بْنِ يَحْيَى الْمَازِنِيِّ، عَنْ أَبِيهِ؛ أَنَّ رَسُولَ اللهِ صلى الله عليه وسلم قَالَ: لاَ ضَرَرَ وَلاَ ضِرَارَ

Amar inb Yahya al-Mazini narrates from his father that the Prophet of Allah (Salallah Alayhi Wa Sallam) said: It is not allowed to cause harm nor to allow being harmed. (Muata Imam Malik-2758) [1]

A resident of a country, whether permanent or temporary has bound himself to obey those laws of the country that are not in consistent with Sharaih. [2]

When a person adopts a residence in a country (permanent or temporary), he agrees to abide by the laws of that country. Shariah advises us to abide by our agreements and going against agreements is against the spirit of a true and upright Muslim. Consider the following hadith:

عَلَى الْمَرْءِ الْمُسْلِمِ السَّمْعُ وَالطَّاعَةُ فِيمَا أَحَبَّ وَكَرِهَ، إِلَّا أَنْ يُؤْمَرَ بِمَعْصِيَةٍ، فَإِنْ أُمِرَ بِمَعْصِيَةٍ، فَلَا سَمْعَ وَلَا طَاعَةَ

A Muslim must listen to and obey (the order of his leader) in things that he likes or dislikes, as long as he is not ordered to commit a sin. If he is ordered to disobey Allah, then there is no listening and no obedience (Muslim-1839)

If a person violates the public safety rules of a country, he is guilty of negligence and apart from facing the wrath of the law, he will also be sinful. [3]

يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الْأَمْرِ مِنْكُمْ فَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ إِنْ كُنْتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ ذَلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا

و قال ابن خويزمنداد: و أما طاعة السلطان تجب فيما كان لله فيه طاعة، و لا تجب فيما كان لله فيه معصية

(الجامع لأحكام القرآن، ج ٣، ص ٢٢٩، دار الحديث)؛

مطلب تجب طاعة الإمام فيما ليس بمعصية

قال في الظهيرية: وهو تأويل ما روي عن أبي يوسف ومحمد فإنهما فعلا ذلك لأن هارون أمرهما أن يكبرا بتكبير جده ففعلا ذلك امتثالا له لا مذهبا واعتقادا قال في المعراج لأن طاعة الإمام فيما ليس بمعصية واجبة اه

(رد المحتار علي الدر المختار، ج ٢، ص ١٧٢، ايج ايم سعيد كمبني)؛

وتجب طاعة الإمام عادلا كان أو جائرا إذا لم يخالف الشرع

مطلب في وجوب طاعة الإمام (قوله: افترض عليه إجابته) والأصل فيه قوله تعالى {وأولي الأمر منكم} وقال – صلى الله عليه وسلم – «اسمعوا وأطيعوا ولو أمر عليكم عبد حبشي أجدع» وروي «مجدع» وعن ابن عمر أنه – عليه الصلاة والسلام – قال «عليكم بالسمع والطاعة لكل من يؤمر عليكم ما لم يأمركم بمنكر» ففي المنكر لا سمع ولا طاعة

الأصل فى الشريعة الأسلمية أنه لأيجوز لأحد أن يفعل فعلا يضر بآخر فان اضر بفعله أحدا فالاصل انه ضامن (بحوث فى قضايا فقهية معاصرة ج1 ص289 مكتبة دار العلوم)
