Dear sir/madam:
My sister who is residing in USA is having some health problems and needs to take medicines approximately every six hours. She has arranged kaffara against her fasting in the month of Ramadan. She is feeding one man in the month of Ramadan who is fasting. Now my question is this that, should she fast the same number of days after she overcomes her health hazards [which will take few more weeks which means that month of Ramadan will end by that time] though she has arranged kaffara? During Ramadan she is a regular salati and fasts every year regularly.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
Your sister does not have to give fidya, rather she should make the fasts up when she overcomes these health hazards.[1]

[1] (ومن كان مريضاً في رمضان فخاف) الخوف المعتبر شرعاً، وهو ما كان مستنداً لغلبة الظن بتجربة أو إخبار مسلم عدل أو مستور حاذق بأنه (إن صام ازداد مرضه) أو أبطأ برؤه (أفطر وقضى) ، لأن زيادته وامتداده قد يفضي إلى الهلاك فيحترز عنه (وإن كان مسافراً) وهو (لا يستضر بالصوم فصومه أفضل) لقوله تعالى: {وإن تصوموا خير لكم} (وإن أفطر وقضى جاز) ؛ لأن السفر لا يعرى عن المشقة فجعل نفسه عذراً، بخلاف المرض، لأنه قد يخفف بالصوم فشرط كونه مفضياً إلى الحرج (وإن مات المريض أو المسافر وهما على حالهما) من المرض والسفر (لم يلزمهما القضاء) لعدم إدراكهما عدة من أيام أخر (وإن صح المريض وأقام المسافر، ثم ماتا؛ لزمهما القضاء بقدر الصحة والإقامة) لوجود الإدراك بهذا المقدار، وفائدته وجوب الوصية بالإطعام.
(وقضاء رمضان) مخير فيه (إن شاء فرقه وإن شاء تابعه) لإطلاق النص، لكن المستحب المتابعة مسارعة إلى إسقاط الواجب (وإن أخره حتى دخل رمضان آخر صام الثاني) ، لأنه وقته حتى لو نواه عن القضاء لا يقع إلا عن الأداء، كما تقدم (وقضى الأول بعده) لأنه وقت القضاء (ولا فدية عليه) لأن وجوب القضاء على التراخي حتى كان له أن يتطوع. هداية.
(والحامل والمرضع إذا خافتا على ولدهما) نسباً أو رضاعاً، أو على أنفسهما (أفطرتا وقضتا) دفعاً للحرج (ولا فدية عليهما) ، لأنه إفطار بسبب العجز فيكتفى بالقضاء اعتباراً بالمريض والمسافر. هداية. اللباب في شرح الكتاب ( ص 170 / ج 1 / المكتبة العلمية )
(أو مريض خاف الزيادة) لمرضه وصحيح خاف المرض، وخادمة خافت الضعف بغلبة الظن بأمارة أو تجربة أو بأخبار طبيب حاذق مسلم مستور وأفاد في النهر تبعا للبحر جواز التطبيب بالكافر فيما ليس فيه إبطال عبادة. قلت: وفيه كلام لأن عندهم نصح المسلم كفر فأنى يتطبب بهم، وفي البحر عن الظهيرية للأمة أن تمتنع من امتثال أمر المولى إذا كان يعجزها عن إقامة الفرائض لأنها مبقاة على أصل الحرية في الفرائض (الفطر) يوم العذر إلا السفر كما سيجيء (وقضوا) لزوما (ما قدروا بلا فدية و) بلا (ولاء) لأنه على التراخي ولذا جاز التطوع قبله بخلاف قضاء الصلاة . الدر المختار ( ص 422 / ج 2 / دار الفكر )
We make Du’aa you are well. The Darul Iftaa was established in the year 2011. The fundamental objective of the Darul Iftaa is to train Ulama from various parts of the world to become Muftis. In this world of scientific calculations and technological advancements, economic confusion and political disarray, a Mufti is trained to understand and analyze current situations and provide leadership for the Ummah.
