Is it permissable to marry a Muslim girl committing Shirk?

Answered as per Hanafi Fiqh by Askimam.org

Assalamualaikum

My question is Does nikah is valid that if I marry a muslim girl who is believing in Allah and also doing shirk(means that girl is going to dargahs and some other places where the shirk is going on)?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Compatibility between spouses is vital for a successful and harmonious marriage. If both spouses have different values, it is possible they will conflict with each other. There won’t be peace and happiness in the marriage.

In the enquired situation, if the woman you refer to goes to the dargah and commit acts of kufr and shirk, then it is not permissible to marry such a person. If she does not commit acts of kufr and shirk, it is permissible to marry her. The nikaah will be valid. However, if she insists on going to the dargah and you rightfully disapprove due to the many incorrect practices taking place at the dargah, then you should exercise caution. Apply your mind carefully in making a decision to marry such a woman. We re-iterate that, compatibility and commonness between the spouses is vital for a happy and successful marriage.

And Allah Ta’ala Knows best
