Claiming back initial Insurance amount

Answered as per Hanafi Fiqh by Askimam.org

As salamu alaykum

I am a Masters student in United States of America. My university has a policy that it is mandatory for all students to have health insurance otherwise they do not let students continue with their studies.

Based on this necessity, I purchased medical insurance for about $2,000. However, I have not used it so far and I have paid for all bills from my pocket instead of sending them to medical insurance company for repayment.

But, now I am struggling financially. I have also heard that in case of medical insurance, it is permissible to claim the amount from the medical company that was originally paid for the insurance (which is about $2,000 in my case).

So, in my case can I claim up to the $2000 that I paid initially for my insurance? Will this be permissible?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It will be permissible for you to claim the total amount you have paid in premiums.[1]
