Can we deal with a person from whom we don`t know where does he get his goods from?

My husband is wanting to do phone business. He is currently getting the latest new phones/electronics from someone online at a very cheap rate. This person claims that he gets the phones with a long process and its legit. He has not told us how…..we pay him through gift cards. Of course there is doubt he could be getting them illegally…..if we buy it from him is this ghunna. he talks to us through snapchat. I wanted to know if this is jaiz? Will our rozi be halal if he is getting them in a wrong way? Also my husband wants to sell them at a much more higher price than he gets them is this allowed?

Answer

In the Name of Allah, the Most Gracious, The Most Merciful.

As-salaamu `alaykum wa-ramatullahi wa-barakatuh.

If the seller of the phones states that he is obtaining the phones in a legitimate way and there is no proof that he is getting the phones illegally, then it is permissible to purchase the phones from him.[1]

It is permissible to sell the phones at a reasonable profit.[2]

And Allah Ta`ala Knows Best.

البيع: ينعقد بالإيجاب والقبول إذا كانا بلفظ الماضي

 

الهداية في شرح بداية المبتدي (4/ 375)

“ومن علم بجارية أنها لرجل فرأى آخر يبيعها وقال وكلني صاحبها ببيعها فإنه يسعه أنه يبتاعها ويطؤها”؛ لأنه أخبر بخبر صحيح لا منازع له، وقول الواحد في المعاملات مقبول على أي وصف كان لما مر من قبل. وكذا إذا قال اشتريتها منه أو وهبها لي أو تصدق بها علي لما قلنا. وهذا إذا كان ثقة. وكذا إذا كان غير ثقة، وأكبر رأيه أنه صادق؛ لأن عدالة المخبر في المعاملات غير لازمة للحاجة على ما مر، وإن كان أكبر رأيه أنه كاذب لم يسع له أن يتعرض لشيء من ذلك؛ لأن أكبر الرأي يقام مقام اليقين،

وشروطه أربعة أنواع، وهي:

شروط الانعقاد، وهي ما لا ينعقد العقد بدونها.

شروط النفاذ: هو ما لا يثبت الحكم بدونها, وإن كان قد ينعقد التصرف بدونها.

شروط الصحة: وهي ما لا صحة له بدونها, وإن كان قد ينعقد وينفذ بدونها.

شرط اللزوم , وهي ما لا يلزم البيع بدونها, وإن كان قد ينعقد وينفذ بدونها

About 2 years ago I had very severe problems with doubts in taharah and salat. AlhamduLillah, these times are far away, and I feel myself much more comfortable. But unfortunately now I suffer from some new doubts which appeared recently. The first problem is regarding materials which doesn’t penetrate water. Before wudhu I’m in doubt whether there are some of them on my heels and near nails. For example, if I have few yarns stuck to my heels, I don’t know whether they are synthetic ones (which don’t penetrate water) or not. Because there are just a few yarns, I can’t advocate whether they penetrate water or not. Also sometimes I find hair stuck to my nails or heels, and again I’m in doubt whether it penetrates water or not. Also if I have some dirt, I’m also in doubt whether it contains some small amount of water-not-penetrating materials. So, my wudhu becomes quite a long procedure, where I try to look at my heels and nails thoroughly trying to remove all the dirt, yarns, stuck pieces of hair. The second problem is in washing my face. I know that we can’t wash one limb with water which was used for washing another limb. So the doubt is as follows: if washing the face my palms will touch hair, I start to think, that on my hands there is water which was used washing my hair, not the face, so I wash my hands, and continue washing the face with new water. The other problem is that I don’t know what part of eyes should I wash – I understand that we don’t need to wash eyes themselves, but what’s about the red area which is near roots of eyelashes (above, under, right and left to eyes)?
