Attributing one’s wife to some other man

Salaam Jokingly calling your wife as someone else’s wife or saying that someone else’s house is her in law’s place, will this constitute divorce

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If one attributes his wife to be someone else’s wife or attributes someone else’s house as her in laws, that does not constitute a divorce. [1]

However, it constitutes a lie, which incurs the wrath and anger of Allah. It is also against shame to refer one’s wife to be someone else’s wife.

Furthermore, such a statement causes pain to the wife. The husband should make taubah and istighfaar for speaking lies and he should seek forgiveness from his wife for the pain caused to her.

What if she makes similar hurtful statements against him? How will he react? Does she expect him to be patient and tolerant with such an intensive conduct? How then does he expect his wife to display patience for such hurtful remarks?

(كنايته) عند الفقهاء (ما لم يوضع له) أي الطلاق (واحتمله) وغيره (ف) الكنايات (لا تطلق بها) قضاء (إلا بنية أو دلالة الحال) وهي حالة مذاكرة الطلاق أو الغضب…

(قوله قضاء) قيد به لأنه لا يقع ديانة بدون النية، ولو وجدت دلالة الحال فوقوعه بواحد من النية أو دلالة الحال إنما هو في القضاء فقط كما هو صريح البحر وغيره
