Inheritance When Grandfather is Alive

By Mufti Ebrahim Desai

Q.) If a person’s father has died, while his grandfather is still alive, will the children get anything in the left over wealth by his father? [Muhammad Tauheed]

A.) If a person is survived only by his paternal grandfather and children, the paternal grandfather will inherit one sixth of the Estate. The residue will be divided among the children. In the presence of the children, the maternal grandfather will not inherit. And Allah Taãla Knows Best.
