Do illegitimate children inherit after their parents get married

Q: A Muslim lady got married to a non Muslim and had 3 children from him. If the marriage is not valid and the children are considered to be illegitimate and not inherit from their father even if later on he becomes a Muslim, are such children still considered to be illegitimate? Will they inherit equally with their brothers who were born after the fathers conversion?

A: They will not inherit from their biological father nor will they inherit from their brothers and sisters born from the father after his  conversion to Islam.

And Allah Ta’ala (الله تعالى) knows best.

(وموانعه ) على ما هنا أربعة ( الرق ) ولو ناقصا كمكاتب وكذا مبعض عند أبي حنيفة ومالك رحمهما الله تعالى وقالا حر فيرث ويحجب وقال الشافعي لا يرث بل يورث وقال أحمد يرث ويورث ويحجب بقدر ما فيه من الحرية قلت وقد ذكر الشافعية مسألة يورث فيها الرقيق مع رق كله صورتها مستأمن جنى عليه فلحق بدار الحرب فاسترق ومات رقيقا بسراية تلك الجناية فديته لورثته ولم أره لأئمتنا فيحرر ( والقتل ) الموجب للقود أو الكفارة وإن سقطا بحرمة الأبوة على ما مر وعند الشافعي لا يرث القاتل مطلقا ولو مات القاتل قبل المقتول ورثه المقتول إجماعا ( واختلاف الدين ) وإسلاما وكفرا وقال أحمد إذا أسلم الكافر قبل قسمة التركة ورث وأما المرتد فيورث عندنا خلافا للشافعي قلت ذكر الشافعية مسألة يورث فيها الكافر صورتها كافر مات عن زوجته حاملا ووقفنا ميراث الحمل فأسلمت ثم ولدت ورث الولد ولم أره لأئمتنا صريحا ( و ) الرابع ( اختلاف الدارين ) فيما بين الكفار عندنا خلافا للشافعي (الدر المختار 6/767)
