Divide Dad’s property fairly?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My father has recently expired. My mother is there with 5 of us, i.e. 2 brothers and 3 sisters. He had given 3.5 lakh to each sister and 4 lakh to me. Now we want to divide the property between my mother and all siblings. Please let me know in what ratio we divide it and how to adjust the money that was already given by my father to 4 of us.

Answer

(Fatwa: 1010/1010/M=1433)

You and your sisters became the owner of the money which your father gifted to you in his lifetime. Those rupees shall not be included in the inheritance of your father. However, the father should have given the rupees to other brothers as well and he should have gifted equally to all his children. However, apart from this amount, the other property and things left by your deceased father, shall be divided into 8 shares after due rights proceeding inheritance. Out of the 8 shares, your mother shall get eighth share i.e. 1 share, and 1-1 share will go to the three sisters and 2-2 shares shall go to each brother. The detail of the division is as follows:

Details:
Wife: 1×01 = 01
Sons: 2×02 = 04
Daughters: 3×01 = 03
Total: 8 shares
