Repeating Talaq to Remember

Question:

One day, I go to the toilet. then I think and said to my mind that I said Talaq sentence to my wife in past time? suddenly, I utter and say this sentence to my wife for remember and recapture talaq sentence in past quarrel moment.

I have no intention. only remember and recapture about talaq.

Now I feel tension. Does any talaq occur?

Answer:

There are two types of words a person can use to constitute a divorce;

Firstly, he can use explicit words such as “I divorce you” or “you are divorced” etc. Using such words would break the marriage whether the divorce is intended or not. (1)

Secondly, he can use ambiguous words such as “leave” or “divorce” etc.

Using such words will not break the marriage by default, rather the intention is going to be considered. (2)

The divorce takes place if a person intended to divorce using such words.

(2)بَابُ الْكِنَايَاتِ (كِنَايَتُهُ) عِنْدَ الْفُقَهَاءِ (مَا لَمْ يُوضَعْ لَهُ) أَيْ الطَّلَاقِ (وَاحْتَمَلَهُ) وَغَيْرَهُ (فَ) الْكِنَايَاتُ (لَا تَطْلُقُ بِهَا)
