An Advice on Following the Islamic Approach in our Family System

Answered as per Shafi'i Fiqh by Darul Iftaa Jordan
What is your advice to women with regards to the best manner to deal with inheritance issues and protect their rights and those of their children`s?

Answer:

All perfect praise be to Allah the Lord of The Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

We advise men and women to understand Islam as it is and as explained by the eminent scholars, not as depicted by those who aim to incorporate Muslims into other civilizations. Having a close look at the condition of families in non-Muslim societies reflects the great blessing of Islam in this regard despite the misapplication of Islam in Muslim countries.

The family used to consist of father striving to please household members, a wife, children, and, sometimes, grandparents. The family loved its leader and sought to help him through good word, kind treatment as well as visible and invisible love. This way, they pleased Allah, gained good reputation and peace of mind. However, the situation of the family has just gone from bad to worse due to cultural invasion. Everybody is trying to control others through an endless struggle and, unfortunately, the victims are the innocent helpless children. The situation fits the meaning of the following verse: "But whosoever turns away from My Message, verily for him is a life narrowed down, and We shall raise him up blind on the Day of Judgment." {Taha, 124}. However, families who are still preserving the Islamic values and customs are happy, quite literally. Indeed, Allah has spoken the truth: " Verily this Qur’an doth guide to that which is most right (or stable), and giveth the Glad Tidings to the Believers who work deeds of righteousness, that they shall have a magnificent reward;" {Al-Isra`, 9}. And Allah the Almighty knows best.
