Question

Husband said to wife: yes, I agree it’s over and I don’t want to be with someone who doesn’t want me the result is divorce. Has talaq happened? And would this be Raji or Bain?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

In the above scenario, it is important to know what the husband means by saying “I agree it’s over” if the husband is referring to his marriage then he says the following what is mentioned above then one divorce will occur because he is emphasizing what he has mentioned. Therefore talaq rajiee has taken place. (Al -Hidayah Vol 2 Pg 385)
