What is considered as Hawaaij-e-asliyyah?

Q: A person has only R1000 in cash but he has 7 cars. He uses one every day of the week.

Does he have to pay sadaqatul fitr, make Qurbani, and cannot receive zakaat because of these cars? He is using them however.

In Behishti Zewar the same type of thing is mentioned for furniture and clothing etc., that as long as he is using the clothes and furniture it will be considered to be from his needs. Does it matter if he has 100 pairs of clothing and 100 cupboards, 10 cars, but uses them? Will this still be considered as his needs, and thus can still accept zakaat? Or do we look at the fact that he only needs one car actually, thus the rest will be above his basic needs.

This would then mean we would have to say the same for clothing and furniture. Or is it correct to say that as long as he uses the items regularly then they will be classified as his needs, no matter how many cars etc he has. If so, How regularly would he need to use the items?

A: If all the cars are being used, they will be regarded as part of his hawaaij asliyyah (basic necessities of life). Hence, such a person does not have to give zakaat as he has less than the nisaab amount and qurbaani will also not be compulsory upon him.

And Allah Ta’ala (الله تعالى) knows best.

تجب على حر مسلم مكلف مالك لنصاب أو قيمته وإن لم يحل عليه الحول عند طلوع فجر يوم الفطر ولم يكن للتجارة فارغ عن الدين وحاجته الأصلية وحوائج عياله والمعتبر فيها الكفاية لا التقدير وهي مسكنه وأثاثه وثيابه وفرسه وسلاحه وعبيده للخدمة فيخرجها عن نفسه وأولاده الصغار الفقراء وإن كانوا أغنياء يخرجها من مالهم ولا تجب على الجد في ظاهر الرواية (مراقي الفلاح مع حاشية الطحطاوى صـ 723)

هي تمليك مال مخصوص لشخص مخصوص فرضت على حر مسلم مكلف مالك لنصاب من نقد ولو تبرا أو حلييا أو آنية أو ما يساوي قيمته من عروض تجارة فارغ عن الدين وعن حاجته الأصلية ولو تقديرا. (مراقي الفلاح صـ 713-714)

قال الطحطاوي : قوله ( وعن حاجته الأصلية ) كثيابه المحتاج إليها لدفع الحر والبرد وكالنفقة ودور السكنى وآلات الحرب والحرفة وأساس المنزل ودواب الركوب وكتب العلم لأهلها فإذا كان عنده دراهم أعدها لهذه الأشياء وحال عليها الحول لا تجب فيها الزكاة وكتب العلم لغير أهلها ليست من الحوائج الأصلية وإن كانت الزكاة لا تجب على صاحبها بدون نية التجارة بحر بتصرف وقوله وكالنفقة لا زكاة فيها ولو حال عليها الحول قال فيه وهو مخالف لما في المعراج والبدائع أن الزكاة تجب في النقد كيف أمسكه للنفقة أو للنماء ا هـ (حاشية الطحطاوي على مراقي الفلاح ص 714)

ومنها فراغ المال عن حاجته الأصلية فليس في دور السكنى وثياب البدن وأثاث المنازل ودواب الركوب وعبيد الخدمة وسلاح الاستعمال زكاة وكذا طعام أهله وما يتجمل به من الأواني إذا لم يكن من الذهب والفضة وكذا الجوهر واللؤلؤ والياقوت والبلخش والزمرد ونحوها إذا لم يكن للتجارة وكذا لو اشترى فلوسا للنفقة كذا في العيني شرح الهداية (الفتاوى الهندية 1/ 172)
