Triple Talaq: Valid or Invalid?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: One of my relatives daughter got married just 18 months back. Their married life is not a happy one. The girl resides in Canada and waiting for her permanent residence which is expected in 6 months time. Her husband lives in India. Both of them are in regular contact via mobile and social media.

During the marriage it was agreed mutually that she will live in Canada till she gets her residence permit. Once she gets the residence permit, her husband is supposed to migrate to Canada. Recently he started pressuring her to come back to India. She and her parents have rejected the idea. In anger her husband sent a whatsapp message with 3 times “Talaaq, talaaq, talaaq”. Now he is calling every one of the family members of the girl to forgive him saying that it all happened in anger and frustration.

In general, it is commonly understood by almost every Muslims that triple talaaq makes the marriage invalid.

Will you please advise under the circumstances whether the talaaq was valid and made their marriage null and void. If so, what needs to be done from an Islamic point of view to redo the nikaah? What is required from the the two parties?

Bismillaah

A: All the talaaqs are valid and his wife is haraam for him.

And Allah Ta’ala (الله تعالى) knows best.
