Can married sister, very poor with husband earning
Answered as per Hanafi Fiqh by Darulifta-Deoband.com
I have following questions. Please let me know the answer according to Islam with proper reference, I will be grateful to you. (1) I have a married sister who is very poor. Her husband’s monthly income is less than Rs 4000 and 4 to 5 dependants . But she owns less than 2 vary (20 gram) gold which we gifted her at the time of her marriage. She receives no allowance from her husband for her personal expense due to small income. We give her sadaqah now and then . Is zakah payable to her? (2) If a woman has 3/4/5 vary gold but less than 7.5 vary and she uses the gold only on occasion. Most of the year it remains unused. Is zakah applicable to her?

بسم الله الرحمن الرحيم

(Fatwa: 849/846/SD=10/1437)

(1) Yes, if your married sister is poor and not sahib-e-nisab then you may give her zakah.

() If the said woman owns some cash along with 7.5 tola gold though only one rupee and the total cost of gold and cash reaches equal to the cost of 613 gram 360 milligram silver then zakah shall be fardh on her whether she uses the gold occasionally. It is not necessary for zakah to be fardh that the gold is in use.
