Do the children of Murhoom Sayed Fazle Elahi have a right to their grandparent’s property?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
As-Salam-O-Alaikum, My elder brother Murhoom Sayed Fazle Elahi died during the life time of our father & mother leaving six children (now five as one died). Please state wheather children of Murhoom Sayed Fazle Elahi have any right or claim over the property of their grand father & grand mother.

بسم الله الرحمن الرحيم

(Fatwa: 1330/1085=D/1430)

If Fazle Ilahi died in the presence of his parents, his children will have no shares in the property of their grandparents; since there are some other brothers of Fazle Ilahi (who will inherit their property). But, it was better for grandparents to give something as gift in their lifetime to their grandchildren. Or now the brothers of Fazle Ilahi, after receiving his shares, should give something to the children of late brother as benefaction and goodwill. This will be a great cause of good conduct with relatives.

Allah knows Best!
