Shopping in supermarkets, shopping centres and malls where music is played

Q: I understand that listening to music is prohibited. However, with the country that we are living in being majority non-Muslims, majority of shops nowadays have some form of music. Is it permissible to visit these shops to purchase items if one does not spend unnecessary time there? What is the best way to deal with the situation when even the vegetable shop has music?

Bismillaah

A: A person should not be present in an environment where sin is taking place. However, while shopping in a supermarket, mall, etc, if a person heard music unintentionally, then since this is unavoidable and one does not have control over the situation, one will not be answerable. One should however detest the sin from the bottom of his heart and make istighfaar while he is in that environment as it is possible that his heart could have taken some enjoyment through the music. As soon as he completes his need, he should leave the environment.

And Allah Ta’ala (الله تعالى) knows best.

(وَما عَلَى الَّذِينَ يَتَّقُونَ) قال أبو جعفر عليه الرحمة: لما نزلت فَلا تَقْعُدْ بَعْدَ الذِّكْرى إلخ قال المسلمون: لئن كنا نقول كلما استهزأ المشركون بالقرآن لم نستطع أن نجلس في المسجد الحرام ولا نطوف بالبيت فنزلت: أي وما يلزم الذين يتقون قبائح إعمال الخائضين وأحوالهم. (مِنْ حِسابِهِمْ مِنْ شَيْءٍ وَلكِنْ ذِكْرى) … أي ولكن عليهم أن يذكروهم ويمنعوهم عما هم فيه من القبائح بما مكن من العظة والتذكير ويظهروا لهم الكراهة والنكير … (لَعَلَّهُمْ يَتَّقُونَ) أي يجتنبون الخوض حياء أو كراهة لمساءتهم. وجوز أن يكون الضمير للذين يتقون أي لكن يذكر المتقون الخائضين ليثبت المتقون على تقواهم ولا يأثموا بترك ما وجب عليهم من النهي عن المنكر أو ليزدادوا تقوى بذلك. وهذه الآية- كما أخرج النحاس عن ابن عباس رضي الله تعالى عنهما. وأبو الشيخ عن السدي وابن جبير- منسوخة بقوله تعالى النازل في المدينة وَقَدْ نَزَّلَ عَلَيْكُمْ فِي الْكِتابِ أَنْ إِذا سَمِعْتُمْ آياتِ اللَّهِ يُكْفَرُ بِها [النساء: 14] إلخ وإليه ذهب البلخي والجبائي وفي الطود الراسخ في المنسوخ والناسخ أنه لا نسخ عند أهل التحقيق في ذلك لأن قوله سبحانه: وَما عَلَى الَّذِينَ إلخ خبر ولا نسخ في الأخبار فافهم. (وَذَرِ الَّذِينَ اتَّخَذُوا دِينَهُمْ لَعِبًا وَلَهْوًا وَغَرَّتْهُمُ الْحَيَاةُ الدُّنْيَا وَذَكِّرْ بِهِ أَن تُبْسَلَ نَفْسٌ بِمَا كَسَبَتْ لَيْسَ لَهَا مِن دُونِ اللَّـهِ وَلِيٌّ وَلَا شَفِيعٌ وَإِن تَعْدِلْ كُلَّ عَدْلٍ لَّا يُؤْخَذْ مِنْهَا أُولَـٰئِكَ الَّذِينَ أُبْسِلُوا بِمَا كَسَبُوا لَهُمْ شَرَابٌ مِّنْ حَمِيمٍ وَعَذَابٌ أَلِيمٌ بِمَا كَانُوا يَكْفُرُونَ) … ونسب ذلك لابن عباس رضي الله تعالى عنهما، والمعنى على سائر الأقوال لا تبال بهؤلاء وامض لما أمرت به.
