Nikah of my Sister at age 3 years .

Assalam o Alaikum.

My father did the Nikah of my sister when she was 3 years old to an 8 years old boy . Now my sister is 23 years old and she refuses the Nikah and she says that she doesn't accept the boy as her husband. The boy says that she is her wife and he won't give her divorce . They never lived together. My sister lives with us since childhood. What is the Islamic point of view? Is my sister in that person's Nikah? Or is this Nikah invalid? Please answer.

The “Nikah” arranged by one’s father becomes valid and obligatory. In such a situation, the girl’s right of to annul her childhood “Nikah” does not apply here. Therefore, it is not right for your sister to reject this valid “Nikah”. This marriage contract will not end until her husband has divorced her. 

However, If there was a genuine reason to terminate this “Nikah”, we advise you to reach out to a “Darul Qadhaa” in your area to settle this matter. 

فان زوجہما الأب والجد فلا خیار لہما بعد بلوغہا۔ (الفتاویٰ الہندیۃ ۱؍۲۸۵ زکریا)

ولزم النکاح … إن کان الولي … أبا أو جدا۔ (شامي ۳؍۶۶ کراچی)

قال النسفیؒ:ولہما خیار الفسخ بالبلوغ فی غیر الأب والجد بشرط القضاء۔ (البحرالرائق:ج؍۳،ص؍۱۳۰، کتابا النکاح، باب الاولیاء والاکفاء)
