Living in Makkah

Assalamualaikum,

I am working and living in Makkah. My residence is in the boundry of Haram. For any purpose either personal or professional if i go out of Makkah and cross Meeqat and I come back to Makkah, after this if I want to perform Umrah is it compulsory for me to go bcak again to Meeqat and make niyah of Umrah..

When I asked one of the Mufti Saheb in Jeddah-KSA regarding the above-mentioned situation he said to me that it is compulsory for me to go to Meeqat again and come back in Ehram. Also he said to me until I go back to Meeqat and come back in Ehram I shoud not go to Masjid Al Haram. If I go then dam will be Wajib on me.

Please clarify regarding this above-mentioned subject and guide me to the correct way.

 

الجواب وباللہ التوفیق

If the residents of Makkah want to do Umrah during their stay in Makkah then it is necessary for them to put on the Ehram from any place in the Hil. The closest place is Tane’em i.e., Masjid-e-A’aishah.

If the resident of Makkah goes out of the Meeqat and then comes back directly to Makkah then in principle the Ehram of Umrah is mandatory and necessary, however, if one needs to go out of the Meeqat and there is hardship and loss due to the Umrah and Ehram being necessary then on this basis the Ulama have described this relaxation that the Umrah is not mandatory on him, he can go to Makkah without Ehram. However, if one does not go again and again rather he goes after month or two months then it is not permissible for him to pass through Meeqat without the Ehram.

In the situation inquired about if you go through Meeqat again and again and on return you do not have the intention for the Umrah then there is relaxation to come in Makkah without the Ehram. If after returning to Makkah if one has the intention to perform Umrah then it is enough to put on the Ehram from the Hil, it is not necessary to go to the Meeqat. However, if he has the intention to perform the Umrah while coming through the Meeqat then it is necessary to put on the Ehram from the Meeqat, it will not be enough to put on the Ehram from the boundary of the Hil.

(وَ) الْمِيقَاتُ (لِمَنْ بِمَكَّةَ) يَعْنِي مَنْ بِدَاخِلِ الْحَرَمِ (لِلْحَجِّ الْحَرَمُ وَلِلْعُمْرَةِ الْحِلُّ) لِيَتَحَقَّقَ نَوْعُ سَفَرٍ۔(رد المحتار :،۲478 )

وقال الشافعي رحمہ اللّہ إن دخلہا للنسک وجب علیہ الإحرام وإن دخلہا لحاجة جاز دخولہا من غیر إحرام ۔(بدائع الصنائع: 2/371)

عن ابن عباس قال لا یدخل أحد الحرام إلا بإحرام فقیل ولا الحطابون قال ثم بلغني بعد أنہ رخص للحاطبین (طحاوي:1/438، ط ہندی)

قال أبوعمر لا أعلم خلافا بین فقہاء الأمصار في الحطابین ومن یدمن الاختلاف إلی مکة ویکثرہ في الیوم واللیلة أنہم لا یأمرون بذلک لما علیہم فیہ من المشقة (عمدة القاري: 10/205، ط کوئٹہ پاکستان)
